Terms of Service
These Terms of Service ("Terms") govern your download, purchase, and use of the cirQlar macOS application ("cirQlar," the "App"), operated by SILVERSIX ("we," "our," or "us"). By installing or using cirQlar, you agree to these Terms. If you do not agree, do not install or use the App.
1. The App
cirQlar is a circular app launcher and productivity overlay for macOS. It lets you arrange apps, files, folders, and shortcuts on radial “circles,” and includes optional features such as the Portal, presets, and an encrypted vault. Features may change over time as the App is updated.
2. License
Subject to these Terms and payment of the applicable fee (after any free trial), we grant you a personal, non-exclusive, non-transferable, revocable license to install and use cirQlar for your own use on Macs that you own or control.
A purchased license is a one-time, lifetime license for the major version line it was bought for. You may activate it on a reasonable number of your own Macs, subject to the activation limit communicated at purchase. We may provide a way to deactivate a device so you can move your license to a new Mac.
You may not:
- copy, resell, sublicense, rent, lease, or redistribute the App or your license key;
- reverse engineer, decompile, or attempt to bypass the licensing or trial mechanisms, except to the extent this restriction is prohibited by applicable law;
- share your license key publicly or use it on machines you do not own or control.
We retain all rights, title, and interest in and to the App, including all intellectual property rights. These Terms do not grant you any rights to our trademarks or branding.
3. Free Trial
cirQlar may be offered with a time-limited free trial. After the trial ends, continued use requires a valid purchased license. The trial start is recorded as described in our Privacy Policy so it is not reset by reinstalling. We may change trial length or availability at any time for future downloads.
4. Purchases, Payment and Reseller
Purchases of cirQlar are processed by Paddle.com Market Limited and/or Paddle, Inc. (“Paddle”), our authorized reseller and Merchant of Record. When you buy a license, your contract for the purchase is with Paddle, and Paddle handles payment, billing, and applicable taxes (such as VAT/sales tax). Paddle’s buyer terms also apply to the transaction.
After a successful purchase, you receive a license key by email, which you enter in the App to unlock it. Keep your key safe; you can recover it via our Support page.
Pricing is shown at checkout and on our Pricing page. We may change prices at any time; changes do not affect licenses already purchased.
5. Refunds
Refunds are handled in accordance with our Refund Policy and Paddle’s buyer terms. See that policy for details and how to request a refund.
6. Updates and Support
We may release updates that fix bugs, improve, add, or remove features. cirQlar may check for and install updates from our servers. We aim to provide reasonable support via https://www.cirqlar.app/support/ but do not guarantee any specific response time, uptime, or that defects will be corrected.
7. Your Content and Data
cirQlar does not integrate third-party analytics, advertising, or tracking services.
8. Acceptable Use
You agree not to use cirQlar for any unlawful purpose or in any way that could damage, disable, or impair the App or interfere with others’ use of it.
9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that the App will be uninterrupted, error-free, or compatible with every Mac or macOS version. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILVERSIX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE IN THE 12 MONTHS BEFORE THE CLAIM. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.
11. Termination
This license terminates automatically if you breach these Terms. We may suspend or revoke a license obtained through fraud, chargeback, or abuse. On termination, you must stop using the App. Sections that by their nature should survive (including 2, 7, 9, 10, and 12) survive termination.
12. Governing Law
These Terms are governed by the laws of Sweden, without regard to its conflict-of-laws rules, and subject to any mandatory consumer protections of your country of residence.
13. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date indicates when changes were last made. Continued use of cirQlar after changes constitutes acceptance of the updated Terms.
